Terms and Conditions

1.GENERAL

i) These Terms and Conditions shall govern all transactions into which Polaris Fire and Electrical Ltd (‘Polaris Fire Products’), a company registered in England, company number 9956496, of Suite A, 3rd Floor, The Clock House, East St, Barking IG11 8EQ, London enters with its customers.

ii) In these Conditions ‘customer’ shall mean the other party to any quotation, offer, order or contract with or by Polaris Fire Products, ‘the goods’ shall mean products manufactured or sold or services performed by Polaris Fire Products or by the customer.

iii) No conditions or stipulations in or attached to any form of order submitted by the customer, or otherwise sought to be imposed by the customer, & which are inconsistent with the conditions or which purport to add to or modify them in any way shall have any effect.

iv) No person in the employment of Polaris Fire Products or acting or purporting to act as an agent of Polaris Fire Products has the authority to accept orders or supply goods on any conditions other than these conditions or to vary these conditions in any way whatsoever, except by written agreement between the customer & a Director of Polaris Fire and Electrical Ltd.

v) No previous dealings or course of conduct between Polaris Fire Products & any customer shall vary or replace or prevail over these Conditions in any circumstances.

2.PRICES & QUOTATIONS

i) All prices listed on the Polaris Fire Products website, or quoted via email, are correct at the time of publication of the current edition thereof. Polaris Fire Products will make all reasonable endeavours to ensure that goods are available at these prices. Polaris Fire Products cannot be held responsible if supplies are unobtainable or otherwise un-saleable.

3.PAYMENT & SETTLEMENT TERMS

i) All orders placed for goods require pre-payment in full via the specified online portals authorised on the Polaris Fire Product website.

4.RETENTION OF TITLE

i) Such goods shall remain the sole & absolute property of Polaris Fire Products as legal & equitable owner until such a time as the customer shall have paid Polaris Fire Products the agreed price in full together with the full price of any other goods the subject of any other contract with Polaris Fire Products.

ii) The customer undertakes to inform Polaris Fire Products of any occurrence such as might compromise its right of ownership.

iii) The customer acknowledges that they are in possession of goods solely as bailee for Polaris Fire Products until such time as the full price is paid to Polaris Fire Products together with the full price of any goods that are subject to any other contract with Polaris Fire Products.

iv) The customer’s right to possession of the goods shall cease if they, not being a company, commit an available act of bankruptcy of if they, being a company, do anything or fail to do anything which would entitle any person to present a petition for winding-up. Polaris Fire Products may for the purpose of recovery of its goods enter upon any premises where they are stored or where they are reasonably thought to be stored & may repossess the same.

5.CARRIAGE & DELIVERY

i) Polaris Fire Products reserves the right to charge carriage on deliveries as appropriate and consistent with the methods shown at the checkout page.

ii) Delivery dates are given in good faith by Polaris Fire Products to indicate estimated delivery times but shall not amount to any contractual obligation to deliver at the times stated in any communication by & on behalf of Polaris Fire Products.

iii) No liability for direct or consequential loss or damage arising from delay in the delivery of goods, including without prejudice to the generality of the foregoing any delays due to any Act of God, war, civil disturbance, strikes, lock-outs or any act outside Polaris Fire Products’ control, will be accepted.

6.GUARANTEES

i) Polaris Fire Products gives no guarantee or warranty on goods supplied by Polaris Fire Products other than that given by the manufacturers concerned or as provided with the orders.

ii) Polaris Fire Products does not accept liability for consequential loss or damage arising from goods supplied by Polaris Fire Products.

iii) All description, weights & dimensions issued by Polaris Fire Products are approximate only & are intended only to present to intending customers a general description of the goods to which they refer, & no warranties or representations are given or should be inferred there from.

(i) Unless specifically stated or advertised, Polaris Fire Products gives no guarantee or warranty on goods supplied by Polaris Fire Products other than that given by the manufacturers concerned or as provided with the orders.

(ii) Polaris Fire Products does not accept liability for consequential loss or damage arising from goods supplied by Polaris Fire Products.

(iii) All descriptions, weights & dimensions issued by Polaris Fire Products are approximate only & are intended only to present to intending customers a general description of the goods to which they refer, & no warranties or representations are given or should be inferred there from.

(iv) Where advertised so, Polaris Fire Products warrants that products will be free of defects in material and workmanship for 12 months from the date of purchase. This warranty is limited to repair or replacement at Polaris Fire Products’ option.

This warranty does not cover damage caused by modification, disassembly, abuse or misuse, wear and tear, improper installation, application, storage, or fault or negligence of a party other than Polaris Fire Products. Polaris Fire Products will not be automatically responsible for incurred costs of products.

Dated proof of purchase and all other information requested is required throughout until process completion. Final judgement of warrantable failure is solely at the discretion of Polaris Fire Ltd.

Polaris Fire Products makes no other warranty, express or implied, of merchantability or fitness for a particular purpose. In no event shall Polaris Fire Products be liable for loss of use, lost profits, theft, property damage, special, incidental or consequential damages.

7.ORDERS

i) Polaris Fire Products reserves the right at anytime & without explanation to: a) Refuse to accept an order, b) Cancel an order, c) Refuse cancellation of an order.

8.RETURNS

i) Please contact us for a Customer Returns number if you need to send anything back to us for repair or assessment. Goods will be rejected without this number.

ii) Where Polaris Fire Products have made an error or the issue is warranty related we will issue you with a Customer Returns number and provide a pre-paid returns label.

iii) Polaris Fire Products reserves the right to refuse any returns or refuse any credit for non-faulty returned goods, should those goods in anyway be unfit for resale. Unfit for resale being entirely at the discretion of Polaris Fire Products.

iv) Goods returned & found to be faulty will be replaced or credited at Polaris Fire Products’ discretion.

v) No liability can be accepted for loss or damage to goods returned by the customer.

vi) If there is a discrepancy between goods advised as returned & the actual goods received, Polaris Fire Products will only credit the goods actually received.

9.COPYWRIGHT

i) The copyright & all other intellectual property rights in all articles, lists, drawings, descriptions & other information produced by Polaris Fire Products shall remain the property of Polaris Fire Products.

10.LAW

i) These conditions are subject to & shall be construed in accordance with the Laws of England & the parties submit to the non-exclusive jurisdiction of the Courts of England.
